Brian Patrick waives trial, pleads guilty to murder

Hunt County – Brian Patrick today waived his right to a jury trial and pled guilty to the murder of James Prothro of Commerce, according to a news release by Hunt County District Attorney F. Duncan Thomas. Thomas said it was an open plea with no agreement as to punishment. The judge will decide punishment on February 28th after hearing evidence in the case.

Patrick could receive up to 99 years in prison on the murder charge, but is claiming that the murder was committed under the influence of sudden passion. If Patrick can prove the claim, the punishment could become no less than 2 but no more than 20 years in prison.

Patrick has also pled guilty to unlawful possession of a firearm by a felon, which carries a two to ten year sentence.
