Case of Commerce man heard in appeals court

By Brad Kellar

Greenville – Attorney's for a Commerce man, convicted for methamphetamine possession, argues a Hunt County sheriff's deputy did not have the authority to make the arrest.

An appeal for Scott Lee James' conviction is being argued this week in Greenville.

At issue was whether the deputy had probable cause to make a traffic stop after observing a violation which occurred in another county. Both sides agreed Wednesday that the circumstances of the case may be without precedent.

The appeals court is scheduled to issue its opinion in about a month.
