Council to discuss lawsuit, drought stage

COMMERCE - The Commerce City Council will meet in executive session Tuesday night to address its nearly yearlong lawsuit against Mayor Quay Throgmorton and his wife, Paige.

In December, the Throgmorton’s filed for Chapter 7 Bankruptcy protection, leaving uncertainly as to the continuation of the lawsuit.

The two sides had entered into mediation talks in the fall. The suit claimed the Mayor and his wife failed to repay the City more than $50,000 in improvements made seven years ago to a development site dubbed the Rosemound Addition project. The Throgmorton's contend that a 2006 payment for more than $34,000 was all that they owed.

As part of Tuesday’s regular session, starting at 6 p.m., the City Council is scheduled to, among other things; receive an update on drought conditions. The City implemented Stage 1 of its Drought Contingency Plan last summer.
