Legal team hired to represent City in lawsuit

Commerce – The legal team of Scott, Money and Ray has been hired to represent the City of Commerce in its lawsuit against Mayor Quay Throgmorton and his wife Paige.

By a 3-1 vote, Council on Tuesday approved a resolution authorizing a letter of engagement with the firm, with Councilman Doug Rohrabaugh voting against and Mayor Throgmorton abstaining.

The City filed suit against the Throgmortons in January for the repayment of nearly $50,000, the remaining costs of the 2005 Rosemound Addition project. The Throgmorton's contend that their $34,000 payment made in 2006 is all they owed.

City Attorney Jim McLeroy, who conducted the investigation which found the remaining funds, informed the Council Tuesday that as a witness in the case he can assist in the preparation but cannot be an advocate of the case.
