New trial pending in 2009 aggravated assault

Greenville – A Rains County man is awaiting word on whether he'll receive a new trial for aggravated assault.

James Earl Lemons, of Point, was convicted by a Hunt County jury in March, 2010 following a shooting incident near the Merit Community. He was given 17 years in prison.

However, in February, an appeals court overturned Lemons' conviction and prison sentence, citing he received ineffective assistance from his defense counsel during trial.

A new trial has not been set, as a judge awaits a formal mandate from the appeals court.
