Settlement expected in illegal dumping case

A resolution is expected this week in a major illegal dumping suit, involving a famous demolition company and Texas A&M University-Commerce.

Final paperwork is scheduled to be considered in the settlement of the litigation against A&R Demolition Inc..

A hearing is scheduled Wednesday in the 196th District Court.

While Hunt County and the Texas Commission on Environmental Quality (TCEQ) have approved the settlement in the case, as of late November the Texas Attorney General had yet to issue a formal approval of the settlement. The final settlement was awaiting a 30-day publication period, which has since expired.

The settlement payment came to $5,600.

The county and the TCEQ filed the suit against the Travis County demolition company, alleging the business illegally disposed of debris from Texas A&M University-Commerce.

Attorneys notified the 196th District Court in July 2013 that an agreement had been reached in the case.

A&R Demolition was responsible for the destruction of Texas Stadium in Irving in April 2010 and Reunion Arena in Dallas in November 2009.

According to the suit, A&R Demolition tore down the former West Halls dormitories on the university campus beginning in July 2010, then illegally disposed of the debris at locations on County Road 4904 — identified in the suit as “the McGee property” — near Wolfe City and on County Road 4204 — identified in the suit as “the Jones property” — between Neylandville and Campbell.

The company and another defendant named in the litigation, Jim Rawson of Justin, had filed general denials of all claims raised in the suit.
