Trial upcoming in area capitol murder case

Greenville – Trial in a Hunt County capital murder case is getting closer.

Defense attorneys for Jerry Lynn Phelps have filed a number of motions in the case, including a request the judge rule the death penalty unconstitutional and appoint two separate juries for both the guilt-innocence and penalty phases.

A pretrial hearing was held Monday. Judge Joe Leonard did not rule on the motions, but did schedule a final pretrial hearing for May 3.

Phelps, of Wills Point, has pleaded not guilty in the shooting death of Charlene Hoover Jones.

Prosecutors have announced they would seek the death penalty for Phelps if he's found guilty.
